Alabama Demand Letter in Lemon Law Cases

Before you file a Lemon Law claim, you must first send a Demand Letter to the manufacturer and/or dealer. The letter must include:

  • Your full name and address
  • A description of the unfair or deceptive act or practice and other important facts
  • The injury you suffered as a result of the unlawful act
  • The Demand Letter must be sent by certified mail, with a return receipt requested.

Once you send the letter, the manufacturer or dealer has seven days to tell you where to take your vehicle for repair, and then has 14 days to repair the vehicle once you have taken it in for repair.

If your vehicle still isn't fixed, you must participate in the manufacturer's informal dispute procedure before you can file a Lemon Law claim.

Only manufacturers can be sued under Alabama's Lemon Law. Car dealers are not held liable for new car lemons.

Here's a Sample Demand Letter:

Dear Merchant:

Under the provisions of the Code of Alabama 1975, Title 8, Chapter 20A, Sections 1-6, I hereby make written demand for relief as outlined in that statute.

On or about [date], I purchased [describe the vehicle]. The vehicle is a lemon because [explain what happened].

Alabama Lemon Law requires that you respond to this letter within 7 calendar days, and that you undertake a "final repair attempt" within 14 days of my bringing the vehicle in for repair.

As a result of this unfair or deceptive act or practice, I suffered injury or loss of money as follows:

[Indicate injury or money or property loss]

Therefore, I hereby demand the following relief:

[Indicate relief, or payment for damages, that you're seeking]
